NAJIB TO BE SWORN IN AS PRIME MINISTER ON 3 APRIL 2009

Outgoing Prime Minister Datuk Seri Abdullah Ahmad Badawi revealed during a press conference at the close of the UMNO General Assembly that he will have an audience with the Yang DiPertuan Agong on 2 April 2009 to express his desire to step down as Malaysia's 5th Prime Minister, making way for Deputy Prime Minister and new UMNO President Datuk Seri Mohd Najib Tun Razak to succeed him.

The Opposition and certain groups have been reporting that Datuk Seri Najib is involved in the murder of Altantuya Shaariibuu which of late have been widely reported overseas after a report from a French daily, which clearly undermines his reputation and credibility while the Opposition is proposing that a Royal Commission of Inquiry should be established to make a finding whether Datuk Seri Najib is involved or not although repeatedly Datuk Seri Najib had indicated that he does not know her.

There are reports that the Istana Negara has plans to have the inaugural ceremony of appointing a new prime minister on 3 April 2009.
Prime Minister Datuk Seri Abdullah who was pressured to reveal the date of transition by reporters were only offered a reply that it would happen "in due course".

NOMINATION DAY FOR 3 AREAS - BUKIT SELAMBAU (KEDAH), BUKIT GANTANG (PERAK) & BATANG AI (SARAWAK)

Surprising events were install at the Bukit Selambau State by-elections when 15 candidates submitted their nominations papers which included Barisan Nasional's S Ganesan and PKR's S Manikumar.

At Bukit Gantang Parliamentary by-elections, the contest is between 'ousted' and legitimate Perak Mentri Besar, Datuk Seri Ir Nizar Jamaluddin from PAS, Barisan Nasional's Ismail Saffian and an Independent candidate Kamarul Ramizi.

While at Batang Ai, Sarawak State elections, its a straight contest against Malcolm Mussen of Barisana Nasional and Jawah Gerang for the PKR.

Looking at the public sentiments, it seems that the Opposition will win the elections but it is still too earlier to speculate since the Barisan Nasional would induce 'goodies' to buy the hearts of the voters and people in the respective areas as usual.

It would be a 'pesta' time in these areas until voting day on 7 April 2009.

CLOCK CHANGES TONITE - 7 HRS DIFFERENCE

The clock would be wind back by 1 hour effective 1am tonite and the difference between Malaysia and United Kingdom would be 7 hours instead of 8 hours from tomorrow.

TUN DR MAHATHIR & WIFE ATTEND UMNO GENERAL ASSEMBLY AT PWTC THIS MORNING

At about 11.25am this morning, Tun Dr Mahathir Mohamad and his wife, Tun Dr Siti Hasmah Mohd Ali appeared at the UMNO General Assembly at PWTC, Kuala Lumpur, much to the surprise of the delegates while he had written in his blog chedet.com yesterday that he was not attending this UMNO General Assembly due to unfair action taken against certain members especially newly elected UMNO Youth Chief Khairy Jamaluddin who although was found to have been involved in money politics but was spared by the UMNO Disciplinary Board.

The leaders were shocked by the presence and their greeted Tun Dr Mahathir and his wife.

Newly elected UMNO Deputy President, Tan Sri Muhyiddin Yassin hopes that Tun Dr Mahathir would immediately rejoin UMNO and his presence shows the support and confidence he has in the incoming committee.

The outgoing President and Prime Minister Datuk Seri Abdullah Ahmad Badawi also officially welcomed Tun Dr Mahathir and his wife to the Assembly and also mentioned this in his speech.

SHAHRIR TO RESIGN AS MINISTER NEXT WEDNESDAY...WHO ELSE?

With the UMNO Annual Assembly about to be over and with 'unexpected' election results, the losers would have to decide or the incoming UMNO President would decide to retain or terminate their ministerial position. Usually to avoid embarrassment, those who lost would gracefully quit. Just giving lame excuses that they are unable to perform since they had lost the confidence of the mere UMNOputras is just excuses to have delegates feel 'uneasy' for not electing them to office.

It was reported that Minister of Domestic Trade and Consumer Affairs Datuk Shahrir Abdul Samad will tender his resignation at the weekly cabinet meeting next Wednesday, since he had lost to retain the UMNO Supreme Council post.

It is further speculated that there are a few others who had lost will also tender their resignation. Among them are Tourism Minister, Datuk Sri Azalina Othman Said who has also lost to retain her position while she is currently being investigated by the Malaysian Anti-Corruption Commission (MACC).

It seem certain that most of outgoing UMNO President Datuk Seri Abdullah Ahmad Badawi's men had lost their positions giving incoming UMNO President Datuk Seri Mohd Najib Tun Razak a free hand in managing the party with much ease.

ABDULLAH AHMAD BADAWI'S FINAL JOURNEY IN UMNO


Outgoing UMNO President, Datuk Seri Abdullah Ahmad Badawi, during his final presidential speech to the delegates at the 59th UMNO Annual General Assembly today, openly and courageously stated his difficulties, achievements and his future aspiration that UMNO needs to follow if it still wants to remain relevant or face a disastrous demise similarly like the incident in the March 8 General Elections which saw for the first time in history the Malaysian public voting a third of parliament by the Opposition.

Datuk Seri Abdullah stated that UMNO is currently contaminated by greed, complacency and internal rivalries and if this situation is not addressed and corrected, UMNO will exit.

Datuk Seri Abdullah too apologised for his shortcomings and weaknesses while claiming that he had carried out his responsibilities with sincerity and honesty in an open situation, while claiming that he had never betrayed UMNO for his own selfish achievements.

Datuk Seri Abdullah further stated that times have changed and UMNO too need to change according to the aspiration of its members while at the same time taking care of the interest of other Malaysians, to live as one happy family. A number of internal factors which have led to the erosion of public trust in UMNO are as follows:

First: Longevity in power has led to complacency and a number of UMNO leaders are increasingly out of touch with the ordinary people who have been the source of UMNO’s strength for so long;

Second: Relative neglect of the rural community in our desire and intent to achieve developed nation status;

Third: Ineffectiveness of UMNO political programmes in reaching out to the younger generation, apart from what is already being implemented by various governmental institutions;

Fourth: Prolonged conflict among ourselves, especially while competing for positions within the party, has eroded the spirit of fraternity among party members;

Fifth: Materialism has seeped into the party, making a number of party members greedy and avaricious, hence creating the negative perception that UMNO is a corrupt party.

These internal factors have given great fodder to UMNO’s enemies in their efforts to tarnish UMNO.

Datuk Seri Abdullah claimed that its time for UMNO to re-examine itself of its weakness and regain its old glory while summarising them as follows:

First: UMNO’s sensitivity in understanding and dealing with the problems and aspirations of the Malays.

Second: UMNO’s ability and success in managing cooperation among the races and UMNO’s openness in acknowledging the role and importance of other races in our country.

Third: UMNO’s ability to reconcile competing and contradictory demands.

Fourth: UMNO’s ability to adapt to social and political changes.

Fifth: UMNO’s ability to absorb newly-emerging social and political forces.

Sixth: UMNO’s ability to seek a balance between the old and the new, the traditional and the modern, the local and the global.

Datuk Seri Abdullah ended his final speech with a token of thanks to his members for giving him the confidence to preside the party while showing appreciations to everyone who had made him achieve this success while passing on the reins to a younger captain, incoming UMNO President Datuk Seri Mohd Najib Tun Razak, to steer the ship; who is young with maturity and experience will be able to navigate this rich and great nation to greater heights.

HARAKAH & SUARA KEADILAN SUSPENDED FOR 3 MONTHS



The Home Ministry has suspended PKR’s newsletter Suara Keadilan and PAS’s newsletter Harakah for three months, effective immediately, its Minister Datuk Seri Syed Hamid Albar confirmed.

Datuk Seri Syed Hamid Albar confirmed that they do not wish to restrict press freedom in Malaysia but these two papers were still publishing untrue stories after they were given warnings, so the Ministry had decided to impose this 3 months suspension.

NIZAR JAMALUDDIN PR CANDIDATE FOR BUKIT GANTANG

'Ousted' Perak Mentri Besar Datuk Seri Ir Nizar Jamaluddin will be the Pakatan candidate for Bukit Gantang Parliamentary by-election. The announcement made at approximately 10.45 pm tonight and amongst the leaders present tonight at the ceramah session attended by approximately 5000 people, are Ustaz Hadi and Azmin Ali. This announcement of the candidacy of Datuk Seri Ir Nizar Jamaluddin was made at Simpang, Perak.

POLICE FIRE TEAR GAS & CHEMICAL-LACED WATER CANNON ON ANWAR'S CERAMAH AT SUNGEI PETANI, KEDAH

Federal Reserve Unit (FRU) forces fired tear gas and used water cannons tonight on more than 5,000 people who had gathered at a ceramah in Bukit Selambau just as Opposition Leader and de facto PKR Adviser Datuk Seri Anwar Ibrahim was about to commence his speech.

It was noted at about 10pm, the FRU engaged the crowd gathered in an open field in front of a shophouse that is being used by PKR as its operation centre for the April 7 by-election.

The opposition leader and other Pakatan Rakyat leaders were holed up in the operation centre until nearly 11pm as police continued breaking up the crowd consisting of women and children outside vigorously with tear gas and chemical-laced water cannons.

It was reported that the crowd of thousands dispersed into nearby housing areas with the FRU giving chase as they continued to fire tear gas.

Among those arrested include fellow party member Zamri Yusuf who is a Senator from Kedah, Datuk Seri Anwar’s chief of staff Ibrahim Yaacob, aides to Kedah Menteri Besar Azizan Abdul Razak and S Manikumar, the candidate for the coming Bukit Selambau by-elections.

JAWAH GERANG - OPPOSITION CANDIDATE FOR BATANG AI

Jawah Gerang has been announced as the PKR candidate for Batang Ai by-election which will be held on 7 April 2009.

This former member of parliament for Lubok Antu candidacy was announced today by Opposition Leader Datuk Seri Anwar Ibrahim.

NORZA BARRED FROM CONTESTING IN UMNO ELECTIONS

The UMNO Management Committee today decided to bar UMNO Supreme Council member Norza Zakaria from contesting in the party polls this coming Thursday as a result of Norza facing a criminal case in the court for alleged money politics.

Norza, who is the Federal Territories UMNO Youth chief, is vying for the supreme council post.

The UMNO annual meeting starts Tuesday ( tomorrow) and will end this coming Saturday.

10,000 PEOPLE ATTEND CERAMAH AT BUKIT GANTANG

More than 10,000 people attended the ceramah at Bukit Gantang where Opposition Leader, Datuk Seri Anwar Ibrahim and 'ousted' Perak Mentri Besar, Datuk Seri Ir Mohammad Nizar Jamaluddin spoke.

But surprise to many, the Opposition did not reveal the name of their candidate who would be fielded at this area in the coming by-election.

From the strong turn-out, it looks very clear that the Opposition will regain this seat without much problems.

ANWAR CERAMAH TONITE AT BUKIT GANTANG - NOT AT TAIPING

The police have declared Opposition Leader Datuk Seri Anwar Ibrahim’s ceramah tonight in Taiping illegal, resulting to a hasty change of venue to Bukit Gantang.

According to organiser Nordin Jaafar, the event will now be held outside the PAS office in Bukit Cempedak, Bukit Gantang, where a by-election will be held on 7 April 2009.

The police have earlier warned the public not to participate in the Taiping ceramah.

ROS COMPLAINTS TO BE LODGED BY BARRED UMNO LEADERS

It is widely speculated that those barred from contesting in the forthcoming UMNO General Election after receiving and fulfilling the required nominations, but due to the recent 'unfair' decision of the UMNO Disciplinary Board would lodge a complaint with the Registrar of Societies (ROS) of their unfair treatment received since every offence should be dealt with according to the UMNO Constitution and Societies Act.

It has been revealed that the UMNO Disciplinary Board had practised unfair double standards, although accused of infringing Party Rules but were allowed for reasons best known to them. These selective punishment is against known rules.

The Registrar of Societies has powers to conduct an investigation pending suspending the UMNO General Assembly or they can also dissolve the UMNO party if they find it is beyond remedy.

Its time that barred and unsatisfied UMNO leaders make a formal complaint so that the ROS can take the required action.

The UMNO Constitution does not allow members to take their grievances to Court but as the Societies Act gives every member the right to seek justice by raising the formal complaint for investigation and for their action.

Will the ROS act against these 'unfair and double standard' treatment?

UMNO HEADING FOR A SERIOUS MAJOR INTERNAL CRISIS

With the barring of aspirant deputy president candidate Datuk Seri Mohd Ali Rustam from UMNO contest by the UMNO Disciplinary Board two days ago, who seem to be aligned to outgoing UMNO President and Prime Minister Datuk Seri Abdullah Ahmad Badawi, and it seems to send a clear signal that incoming UMNO President Datuk Seri Najib Tun Razak is conducting a silent spring-cleaning to get rid of Datuk Seri Abdullah's group using 'proper' procedure without creating chaos.

It looks like within the next couple of days, if Datuk Seri Najib is not stopped, he will eventually get rid of Datuk Seri Abdullah loyalist, allowing him total control of UMNO with his loyalist in full control.

The time has come for outgoing UMNO President Datuk Seri Abdullah to institute stern measures to ensure that everyone is allowed to contest so that UMNO, which at the present moment seem to be hatred by everyone, will regain its credibility and integrity, while prosecuting all crooks without looking at their status or aspiration.

The best likely choice would be to defer the UMNO General Assembly to another date until every internal crisis is resolved amicably.

VOTE BUYING - ISN'T IT CORRUPTION?


UMNO Disciplinary Board yesterday had found Malacca Chief Minister, Datuk Seri Mohd Ali Rustam and MP for Rembau, Khairy Jamaluddin for vote buying in the forthcoming UMNO Elections.

But its surprising that Datuk Seri Mohd Ali Rustam would still be the Malacca Chief Minister, while Khairy Jamaluddin, the MP for Rembau.

Vote buying means CORRUPTION and its an offence and these persons should be arrested and charged according to the laws of Malaysia.

Since they are UMNOputras, it seems UMNO Law has been applied, UMNOputras can do anything, but nothing happens.

Its time our UMNO-led Barisan Nasional federal government disclose to us why when its an offence, these persons are not arrested and charged and are able to keep their positions ?

It needs to be noted that everything is NOT FINE in Malaysia. The above chart will tell the truth.

But surprise to many our UMNO-led Barisan Nasional government keeps distorting the true picture.

Dailies seem to focus on the on-coming UMNO Delegates Conference and the personalities contesting, rather than having full focus to combat the worrisome economic crisis.

ALI RUSTAM BANNED FROM CONTESTING DEPUTY UMNO PRESIDENT


The UMNO disciplinary board has found Malacca Chief Minister Datuk Seri Mohd Ali Rustam guilty of breaking party election rules.

The board's chairman Tengku Tan Sri Ahmad Rithauddeen Tengku Ismail informed at the party headquarters today that Datuk Seri Mohd Ali Rustam will now be banned from contesting the UMNO deputy presidency.

Tengku Ahmad Rithaudeen also confirmed that incumbent UMNO Youth deputy chief Khairy Jamaludin had also been found guilty of breaking election rules. Khairy, will however be allowed to contest the wing's top post.

Former Selangor Mentri Besar Datuk Seri Dr Mohd Khir Toyo, has been cleared of any wrongdoing.

Talk had been rife over the past few days that Datuk Seri Mohd Ali Rustam, who was said to be doing well in the contest for the UMNO No. 2 post, was being investigated by the board. The speculation raised the political temperature as the party election campaign entered its final lap, with just days left before more than 2,000 delegates chose the new party line-up.

The UMNO general assembly will begin at the PWTC here on Tuesday.The UMNO deputy presidency will now be a two-man contest, between Tan Sri Muhyiddin Yassin and Tan Sri Muhammad Muhammad Taib.

KARPAL SINGH TO BE CHARGED FOR SEDITION

Karpal Singh, the Member of Parliament for Bukit Gelugor and DAP Chairman, will be charged in the Jalan Duta lower court under Section 4(1)(b) of the Sedition Act for his alleged threat to sue the Sultan of Perak, Sultan Azlan Shah for acting beyond his powers and consenting to the appointment of Datuk Dr Zambry Kadir as the new Perak Mentri Besar which was reported to have been uttered on 6 February 2009.

Karpal Singh's daughter Sangeep Kaur Deo confirmed that her father was served with a notice by a policeman on Monday to be present at the Jalan Duta court at 9am on Tuesday.

Another swift action by the UMNO-led Barisan Nasional government when many old, serious and important cases are still pending investigation.

GOBIND SINGH SUSPENDED FOR 12 MONTHS

Minister in the Prime Minister's Department Datuk Seri Nazri Abdul Aziz's motion to suspend Puchong Member of Parliament Gobind Singh for 12 months was passed in Parliament today after a 40 minute debate at about 1pm today.

The motion claimed to be serious since Gobind had accused DPM Datuk Seri Najib for being involved in the mysterious brutal murder of Mongolian Altantuya Shaariibuu after a recent newpaper report from a french daily.

A historical plaque placed by the rakyat where the State Assembly sitting of 3 March 2009 was held after been unlawfully barred entry to the State Assembly building by the Perak State Secretary and Perak Police to convene an emergency State Assembly sitting for which all the proper procedures had been adhered had be completely REMOVED presumably by the Ipoh City Council’s Enforcement Department at 7am using a tractor yesterday.

This DEMOCRACY PLAQUE under this Democracy tree will NEVER be forgotten and with time it will be re-erected, to show our future generation to what extend our unscrupulous, arrogant and corrupted UMNO-led Barisan Nasional leaders will do to see that their dirty tricks are not exposed in public.

EPF DIVIDEND FOR 2008 - 4.5%

It's bad news for Employees Provident Fund (EPF) contributors, the dividend for 2008 is expected to be as low as 4.5%.

The time has come for the contributors to demand an explanation for the low dividend rate since the EPF is cash rich, unless the EPF Board had mismanaged the funds.

The announcement for Bukit Gantang and Bukit Selambau were made by Deputy Prime Minister Datuk Seri Najib Tun Razak in Taiping, Perak and Sungai Petani, Kedah respectively, while the Batang Ai was made by Sarawak Chief Minister Tan Sri Taib Mahmud.

ONLY 19% OF THE MALAYS SUPPORT UMNO & WANT THEM TO FORM THE NEXT FEDERAL GOVERNMENT

Most people have forgotten that UMNO of 1946 is already DEAD and GONE. The UMNO we refer to today is UMNO BARU or UMNO FORMED BY DR MAHATHIR in 1988.

A recent survey has revealed that only 19% of the Malays are supporting UMNO today.

UMNO has always been portraying that they are the CHAMPIONS OF THE MALAY RACE and this shocking percentage of support show that the Malays have finally realise how uncaring, arrogant, corrupted and selfish are UMNO leaders to their mere grassroot supporters and other Malays who do not support or are members of this party.

It seems clear that the next general election would see the eventual DEMISE of UMNO from the political arena in Malaysia, if it does not reform.

PERAK STATE SPEAKER V SIVAKUMAR CAN HAVE HIS OWN LAWYERS

The Court of Appeal today allowed Perak State Speaker V Sivakumar to be represented by his own counsels in two pending suits related to the Perak crisis.

The decision of the three-member bench led by Justice Md Raus Sharif was unanimous. The other two judges were Justice R Abdull Hamid Embong and Justice Ahmad Maarop.

Both suits are underway in the Ipoh High Court and presided by novice Judicial Commissioner Ridwan Ibrahim.

The first matter involves three independent State Representatives (frogs) seeking to quash the Speaker's ruling that their seats were vacant;

while the second suit, was brought by Menteri Besar Datuk Dr Zambry Abd Kadir and his six Exco members from the 'dubious' UMNO-led Barisan Nasional against the Speaker for barring them from the State Assembly.

The Court finds there is no provision requiring the Speaker to appoint the State Legal Advisor as his representative and have found that the Speaker is not considered a State Officer or a government officer (civil servant) under the Government Procedures Act 1956.

As such, the court sets aside the March 3 orders by the Ipoh High Court.

Following this decision today, Tommy Thomas and his team of seven lawyers including Chan Kok Keong, Philip Koh, Ben Chan, Yap Boon Kah, Leong Cheok Keng, Nga Hock Cheh and Colonel Yunus would appear for Perak State Speaker V Sivakumar.

However, the application to replace Judicial Commissioner Ridwan Ibrahim from hearing these two suits following today's decision, the Court of Appeal held that it was better for Tommy Thomas to write a proper application for consideration.

At last, justice had been served.

MOTION TO SUSPEND MP FOR PUCHONG GOBIND SINGH FOR 1 YEAR

The UMNO-led Barisan Nasional government has submitted a Motion at the Parliament seeking for a 12-month suspension of Puchong Member of Parliament, Gobind Singh over his outburst last Thursday over him implicating Deputy Prime Minister Datuk Seri Najib Abdul Razak in a Mongolian Altantuya Shaariibuu murder case that had been widely reported in detail in a French daily.

The Motion, submitted by Minister in the Prime Minister's department Datuk Seri Nazri Abdul Aziz, will be debated and voted when the Parliament resumes its sitting on Monday at 11.30am.

This clearly shows that the UMNOputras would do anything to distort the public from 'protecting' their colleagues who have been alleged to be involved in this mysterious brutal murder, rather than to prove his innocence in the court of law.

Deputy Prime Minister Datuk Seri Najib is expected to takeover the premiership sometime next month and this report would not show credibility and integrity of the federal government.

If passed, this Motion would mean Gobind would be suspended for 12 months, without enjoying any allowance and perks as an MP.

FEDERAL COURT OVERTURNED ELECTION COURT DECISION ON PENSIANGAN

The Federal Court in Kota Kinabalu this morning overturned an Election Court decision on 8 September to strip Pensiangan MP Tan Sri Joseph Kurup of the seat and declare it vacant, while declaring Tan Sri Kurup was duly elected to the parliamentary constituency of P182 Pensiangan.

The Federal Court held that there had not been any failure on the part of the Returning Officer (RO) to comply with the election laws.

DEMOCRACY PLAQUE VANDALISED TODAY


The democracy plaque placed under the historical Democracy Rain Tree has been vandalised today, the 13 March 2009 since the UMNO-led Barisan Nasional 'dubious' State leaders and federal government are unable to accept the significance of the rakyat in witnessing their State Assembly sitting at this tree which was held since the legitimate lawmakers were barred entry into the State Assembly to convene their State Assembly sitting.

But this comes as NO SURPRISE. The Perakians would have to continue to demand for a FRESH STATE ELECTIONS so that a new clean, able and responsible State government is formed.

Nothing is lost yet, but for sure Barisan Nasional would receive a much more disastrous defeat in the coming State elections for deceiving the Perakians with the aid of the Palace.

6 BLOGGERS TO BE CHARGED FOR SULTAN PERAK INSULT

Perak seem to be on the spotlight everyday with surprising events, and today, its reported that six bloggers and some who posted comments insulting the Sultan of Perak, Sultan Azlan Shah for his action in appointing the unscrupulous Barisan Nasional leaders as Mentri Besar and Exco members by using dubious means to wrest the State Administration while the legitimate Pakatan Rakyat Mentri Besar and the Exco Members had not resigned which is in total violation of the State and Federal Constitution are going to be charged in court.

The demand made to the Sultan to dissolve the State Assembly was just neglected for reasons best know to the Sultan but since his subjects want a fresh State Election to overcome the political turmoil faced by Perak, until to date nothing has been forthcoming, but the Sultan seem to be validating an illegal act by participating in the Barisan Nasional organised functions.

To create further doubts on the 'wisdom' used by the Sultan on his haste decision, numerous reports show the royal family heavily indebted to the Barisan Nasional for multi-million ringgit contracts awarded to them.

It need to be emphasized that whatever action taken by the authorities would not change the public image and opinion since the Perakians are demanding for the dissolution of the State Assembly, paving the way for a fresh State elections, so that a new and able State government could be formed.

The continued harassment against bloggers and 'frank' commentors, could see a change where the monarchy system is Malaysia may be abolished, with the establishment of a REPUBLIC.

The Rulers and the Executive need to realise that the real power is vested with the RAKYAT and at the next general elections, this will dictate.

IPOH HIGH COURT JUDICIAL COMMISSIONER RIDWAN IBRAHIM MAKES MOCKERY & RIDICULE OUR FEDERAL CONSTITUTION

It was reported today that the Ipoh High Court Judicial Commissioner Ridwan Ibrahim has once again refused to abide by the Federal Constitution when hearing the application filed by three pro-Barisan Nasional independent assemblypersons (frogs) against the Perak State Speaker for wrongly declaring their seats vacant while relying on their resignation letters submitted by their respective political parties.

First, Section 72 Clauses (1) to (3) of the Federal Constitution, provides that Perak State Speaker's actions in the State Legislative Assembly could not be brought to court,

while secondly, Article 132, Clause (3) of the Federal Constitution clearly states that the public service shall not be taken (b) to comprise the office of President, Speaker, Deputy President, Deputy Speaker or member of either House of Parliament or of the Legislative Assembly of a State.

Since this novice Judicial Commission had classified the Perak State Speaker as a public service officer, he had further ruled today that V Sivakumar cannot represent himself by virtue of his position as the Speaker of the Perak State Assembly is in total disrespect of our Federal Constitution and is creating severe legal implications to the nation by not abiding by the foremost rule of the law.

The time has come for the Judiciary to terminate this 'incompetent' Judicial Commissioner before he create much more damage to the judiciary which to date is viewed with 'suspicion'.

SURUHANJAYA INTEGRITI AGENSI PENGUATKUASA (SIAP) TABLED BUT HAS 'NO POWERS'

The Special Complaints Commission (SCC) which was tabled last year to replace the (Independent Police Complaints and Misconduct Commission (IPCMC) was criticized as a mere "post box" in that it is toothless (no power to persecute) and it just act to receive complaints and forward these complaints to relevant enforcement agencies thus essentially acting like a "post box" while adding another layer to cumbersome bureaucracy.

Today, Home Minister, Datuk Seri Syed Hamid Albar has tabled another bill in Parliament, the Enforcement Agency Integrity Commission or SIAP (Suruhanjaya Integriti Agensi Penguatkuasa). SIAP will also have no persecution power and is likely to meet the same fate as SCC.

The UMNO-led Barisan Nasional government 'fears' to form a credible Commission which has absolute persecution powers, since most of its UMNOputras or Barisan Nasional officials would face prosecution.

MALAYSIA TURNING OUT TO BE A JOKE

Although not surprised, but with more awareness among the Malaysian public, it would have been sensible that a thorough and frank investigation had been conducted rather than 'covering-up' bad practices and personalities which by now will completely tarnish the already bad reputation of the UMNO-led Barisan Nasional federal government among Malaysians but would turn to be real a JOKE within Malaysia and internationally, with people labelling this government as manipulative, ineffective, uncaring and corrupted.

Today, while replying to Gobind Singh Deo (DAP-Puchong) at Parliament, Minister in the Prime Minister’s Department Datuk Seri Nazri Aziz informed that Inspector-General of Police Tan Sri Musa Hassan and Attorney-General Tan Sri Gani Patail were cleared of any wrong-doing after a two-month investigation conducted by the Malaysian Anti-Corruption Commission (MACC) after Datuk Seri Anwar had accused both Tan Sri Abdul Gani and Tan Sri Musa of tampering with evidence in an investigation into an alleged beating he received from then IGP Tan Sri Abdul Rahim Noor while in police custody in 1998.

The independent panel was made up of former Federal Court judges Datuk Abdul Kadir Sulaiman and Datuk Wira Mohd Noor Ahmad, and retired Court of Appeal judge Datuk Mohd Noor Abdullah.

Another important tragedy has been 'covered-up' and the reasons for doing so is so obvious.

The time has come for Malaysians to show their displeasure when the next general elections are called by overthrowing this uncaring, arrogant, ineffective, inefficient, manipulative and corrupted Barisan Nasional government once and for all.

PERAK SPEAKER COMMENCES COURT ACTION TO COMPEL ELECTION COMMISSION TO HOLD ELECTIONS ON THREE 'FROGS' STATE SEATS

The Perak State Assembly Speaker, V Sivakumar today filed a judicial review application at Kuala Lumpur together with others to compel the Election Commission to hold fresh State elections in Behrang, Changkat Jering and Jelapang, as a result of resignations letters received by him while declaring these State seats vacant.

The unprecedented decision of the Election Commission not to hold a fresh State Elections and allowing these 'frogs' to claim themselves as Independent with Barisan Nasional friendly had created a mockery and this matter need to be resolved since the Perak State government is under political turmoil with both fractions, Pakatan Rakyat and Barisan Nasional claiming to lead the State.

The application for judicial review was filed at High Court registry in Jalan Duta at 3.20pm today.

This Tronoh Assemblyman who is Perak State Speaker, is seeking an order for the three assemblypersons to present authorities or powers stipulating they are still elected representatives for their respective constituencies.

In addition, he is seeking:

that the three state seats be declared vacant and cleared following the resignation of the three representatives from Pakatan;

an injunction against the three respondents or their agents to make a representation that they are the rightful elected representatives and are responsible, with the functions and job as a state assemblypersons;

an order of certiorari to quash the EC’s decision not to call for by-elections in Behrang, Changkat Jering and Jelapang;

an order of mandamus (to compel) the EC to hold by-elections in the three state seats; and punitive, aggravated and exemplary damages from the court as a result of the course of the action and other relief sought and awarded by the court.

It seems that the Perak episode would not be resolved unless a fresh State elections is convened and it is hope that the ultimate saver of justice for his subjects, the Sultan of Perak would consent to dissolve the State Assembly immediately, paving a way to hold fresh elections and to overcome these uncertainties faced in Perak

A NOVICE IPOH HIGH COURT JUDICIAL COMMISSIONER MISINTERPRETES LAWS OF MALAYSIA, INSTEAD USES UMNO LAW

Various legal experts have clearly proven that the Judicial Commissioner at the Ipoh High Court, Ridwan Ibrahim had wrongly interpreted the law when he applied to hear and decide on the cases pertaining to the current feud faced by the Pakatan Rakyat and the Barisan Nasional parties.

The JC had barred the Perak Speaker's personal lawyers from representing for him on the objections raised by the Opponent's lawyers by misinterpreting Section 24 of the Government Proceedings Act 1956, by suggesting that the Speaker is a public officer and need to be represented by a State Legal Officer, when the same legal officers had appeared for the opponents in another matter which tantamount to conflict of interest while this State Legal Officer have not received the Speaker's permission to represent him or have they been advised about the matter.

But surprise to many, Article 132, Clause (3) of the Federal Constitution clearly states that the public service shall not be taken (b) to comprise the office of President, Speaker, Deputy President, Deputy Speaker or member of either House of Parliament or of the Legislative Assembly of a State.

With this revelation it clearly illustrates that the Order granted by this novice JD from the Ipoh High Court is a illegality since Section 24 (2) of the Government Proceedings Act does not apply.

Further more, Article 72, Clauses (1) to (3) Federal Constitution clearly spells out that (1) the validity of any proceedings in the Legislative Assembly of any State shall not be questioned in any Court.

So now you know from the Federal Constitution itself that the validity of the suspension of Datuk Dr Zambry and his six Exco members from the Barisan Nasional by the Speaker in the State Assembly cannot be questioned in any court and the Speaker's decision is binding, lawful and need to be followed without question.

The Federal Constitution is the supreme law of our nation and for this novice JC to misinterpret it, clearly shows his complete incompetence in the law or he has invented a new law - UMNO LAW to replace our Federal Constitution or Laws of Malaysia so that his appointment tenure could be extended and he be elevated if he were to assist this unscrupulous UMNO-led Barisan Nasional federal government to wrest power through the back door. (Even the Minister-in-charge was unaware that this JC's appointment expired on 28 February 2009 and only came to realise this after a blog report was made after the 3 March 2009 court episode). Rightfully, the JC should have been prevented from hearing this case and/or disallowed into the Court premises.

If this novice JC had seeked the assistance of the eminent Counsel Tommy Thomas to submit as an amicus curiae, this case would not have turn this ugly and created such a mess, indirectly undermining the independence of the judiciary while creating a mistrust on every Judicial officer by the rakyat.

MARBLE PLAQUE TO HONOUR 'DEMOCRACY TREE' PLACED TODAY


It was reported that a marble plaque had been placed today to honour the historical event of the Perak State Assembly sitting convened at this 'democracy tree' when the Perak State Secretary and Ipoh Police had barred entry for the elected State Assemblymen and Assemblywomen from having their lawful State Assembly sitting on 3 March 2009.

This historical tree will always be remembered by the generation to come that PEOPLE'S POWER will be the ultimate force, not the Palace or political parties.
