THE HIGH COURT TO REINSTATE KOTA SIPUTEH (KEDAH) ASSEMBLYMAN ON MONDAY


Deputy Prime Minister Tan Sri Muhyiddin Yassin statement today demanding Kota Siputeh Assemblyman Datuk Abu Hassan Sarif to attend Tuesdays Kedah State Assembly sittings are indication that the High Court in Kuala Lumpur will reinstate Datuk Abu Hassan Sarif as still the Assemblyman despite him without informing had absent himself for two consecutive sittings.

According to the Assembly laws, any elected State Assemblyman who is absent for 2 consecutive assembly sitting without prior approval, his seat is deem vacant and a fresh election need to be called by the Election Commission.

It seems that the Election Laws supersede Kedah State Laws, when it appears to be a member of the ruling government, Barisan Nasional and this misuse and flaw of Malaysian Federal and State Laws will undermine future cases, creating a great mockery of the legal institution.

It seems so clear that Datuk Abu Hassan Sarif will be reinstated on Monday from the statement made by deputy premier Tan Sri Muhyiddin Yassin.
