PKA can't take legal action against Chan Kong Choy


The Port Klang Authority (PKA) said today that it cannot take legal action against former transport minister Chan Kong Choy over the Port Klang Free Zone (PKFZ) scandal because he was not a member of the PKA staff.

NONEThis is unlike former PKA general manager OC Phang, who was charged with criminal breach of trust (CBT), and three others who were charged with making false claims, said PKA chairperson Lee Hwa Beng.

Hence, PKA can only rely on the police or the Malaysian Anti-Corruption Commission (MACC) to take action against the former minister, Lee told reporters after attending PKFZ's Chinese New Year open house in Klang.

The Public Accounts Committee (PAC) had recommended in its report on the PKFZ controversy last year that Chan and Phang should be probed for CBT over the wrongful issuance of three letters of support by Chan and three letters of undertaking by Phang without the approval of the Finance Ministry.

Given Phang and three others have been charged, the lack of action against Chan has raised eyebrows.

Eight civil suits

Lee also clarified that PKA had not yet let off the former board directors, although the current board had wrapped up its internal investigation on the PKFZ scandal.

He said PKA will take legal action if there are new findings from the police or MACC.

He also revealed that PKA had filed eight civil suits against Phang, Kuala Dimensi Sdn Bhd (KDSB), PKFZ's turnkey contractor, and others over the PKFZ scandal.

"These suits cover everybody involved in the scandal," he claimed.

Lee said if the suits against KDSB are sucessful, PKA would be able to save the taxpayer money as there is still RM2.8 billion owed to KDSB.
